1.1 The VibeWalls Privacy Policy applies to all products and services provided by VibeWalls, including the VibeWalls mobile client ("APP") and other client applications.

1.2 Before using any VibeWalls products or services, please read and fully understand this Privacy Policy. By using or continuing to use VibeWalls products/services, you agree to our use and processing of your personal information in accordance with this Privacy Policy.

1.3 We may revise this Privacy Policy from time to time in accordance with laws and regulations or business needs. After any changes are implemented, we will notify you of the updated content through prominent notices or other means following the release of the revised version.

1.4 You must understand that we will only collect, use, process, and store your personal information in accordance with this Privacy Policy after you confirm and agree to it. You have the right to refuse to agree to this Privacy Policy, but please note that refusal may result in incomplete access to VibeWalls' services and features or failure to achieve the intended service outcomes.

2.1 We fully recognize the importance of your personal information and are committed to ensuring its security. To maintain your trust in our services, we pledge to protect your personal data in compliance with local legal and security standards. If we need to use your personal information for purposes not specified in this Privacy Policy or collect data beyond designated purposes, we will promptly notify you through reasonable means and obtain your consent.

2.2 We typically collect and use your personal information for the following purposes:

2.2.1 [Maintaining Basic Functions] To identify account anomalies, assess product compatibility, and provide essential services such as browsing, we may collect and store information regarding your service usage and behavior. This includes:

Log information: When you use our services, we may collect detailed usage data for network log storage. This includes your login account, access history, membership activation records, and save/share records.

Device information: Based on the permissions you grant during software installation and use, we may collect and record device-related information, including device model, operating system and version, client version, and device identifier (IMEI/Android ID/OAID).

Mobile network information, such as the Public Land Mobile Network (PLMN) provider ID, geographical location (cell ID of the device's location), and Internet Protocol address.

2.2.2 [Registration & Login] When you register a VibeWalls account, we collect voluntarily provided information including third-party media platform account details, email addresses, and dynamic verification codes for identity authentication. Please note that email addresses and dynamic verification codes constitute sensitive personal information and should not be disclosed to third parties. This data collection is essential for account registration and personal account creation. Your provided information remains under our usage authorization throughout service utilization.

2.2.3 [Set Wallpaper] To use wallpaper-related services, you must enable storage permissions and system wallpaper modification permissions. If you do not grant these permissions, the above features will be unavailable, but other VibeWalls functions and services remain unaffected. You can enable or disable these permissions at any time through device settings.

To deliver optimal wallpaper experience, VibeWalls collects device information including model, operating system version, screen resolution, and network status. Based on your device's specifications, it displays wallpapers with appropriate resolutions and formats to prevent errors or resource waste. The platform also optimizes wallpaper loading according to your device performance and network conditions.

2.2.4 [Lock Screen Settings] To use the lock screen service, you must enable the following permissions: background pop-ups, lock screen display, floating windows, auto-launch, and app notification reading. Without these permissions, the aforementioned features will be unavailable, but access to other VibeWalls functions remains unaffected. You can manage these permissions anytime through device settings. If you revoke these permissions, we will cease providing the corresponding services.

2.2.5 [Image and Video Creation Services] When using VibeWalls 'image and video creation services, we may process the photos, images, and videos you upload. After uploading these files, we conduct feature analysis to enable AI-generated content. This process requires access to your device's camera and photo album permissions. These are sensitive permissions that we only use with your explicit consent. You may revoke this authorization at any time.

Unless otherwise explicitly stated and with your explicit consent, we will not transmit, store, or share the aforementioned information with third parties. All such data is processed solely on your device. We will never sell your personal information to any third parties. Once image generation is complete, your original photos will be immediately deleted. We will retain anonymized or aggregated data only when necessary to achieve the purposes outlined in this Privacy Policy.

We will never turn on your camera or access your photo album to steal your privacy or view your images. We will never use such illegal methods to send you messages or advertisements.

2.2.6 [Friend Posting Feature] To ensure stable and compliant operation of the friend posting feature, when you add friends through this function, we collect your friend invitation code, records of friend relationship establishment and termination, and your friend list. During interactions with friends, we gather locally sent photos, mood status content, and usage records related to location and battery level. The aforementioned information is exclusively used for friend addition and related interaction functions and will not be utilized for other purposes.

2.2.7 [Audio/Video Display, Playback & Download Services] When using audio/video display and playback features, we collect browsing history, playback records, and saved content. To enable download functionality, we request access to your device storage. If you decline this request, you will lose access to VibeWalls' video download feature, but your basic audio/video display and playback services remain unaffected.

2.2.8 [Third-Party Services] Our products may incorporate third-party SDKs, advertisers, or similar applications. By using such third-party services on our platform, you consent to their direct collection and processing of your personal data. The data collection practices of third-party SDK providers and advertisers are governed by their respective privacy policies and do not apply to this policy. To ensure maximum information security, we recommend reviewing the privacy policies of any third-party SDK services prior to use. To protect your legal rights, if you identify risks associated with SDKs or similar applications, we advise you to immediately terminate related operations and contact us promptly.

2.2.9 [Customer Support & Feedback] When you submit complaints, appeals, or assistance requests regarding VibeWalls, we may need to cross-check your account information against previously provided personal data to ensure account and system security. To facilitate communication and issue resolution, we may require additional personal information including name, email address, and contact details. We will also collect communication records and related information relevant to your request. This data collection is essential for investigating situations and assisting in resolving your inquiries. If you refuse to provide this information, we may be unable to respond promptly to your complaints, appeals, or consultations. During these processes, you may need to enable photo album or camera permissions to communicate with customer service and submit required materials. You can manage these permissions through device settings at any time.

With your consent, we may also share marketing materials such as new feature announcements, exclusive offers, and other VibeWalls content that we believe you may find interesting.

All marketing messages include clear unsubscribe options. You can adjust your preferences in account settings. We respect your choices and will never send you annoying spam.

2.2.13 To upgrade your mobile client or integrate third-party ads into our products/services, you may need to enable app installation permissions. If you decline, you may not be able to complete the APP upgrade or use third-party products/services.

2.2.14 The functions and services we provide are continuously updated and enhanced. If any function or service not listed in the above description still collects your information, we will inform you of the content, scope, and purpose of the information collection through page prompts, interactive processes, or announcements to obtain your consent.

In addition, we process your personal data solely in accordance with applicable laws. Where permitted by local laws, we may use your personal data based on one of the following legal grounds: your consent; performance or execution of contracts with you; protection of your or others' legitimate rights and interests; fulfillment of legal obligations; or safeguarding the legitimate interests of our business operations.

3.How we use cookies and similar technologies

3.1 Cookie

To ensure smooth website operation and provide you with a seamless browsing experience, we store small data files called Cookies on your computer or mobile device. Cookies typically contain identifiers, site names, and a combination of numbers and characters. Through Cookies, websites can store your preferences and other data.

4.1.1 Your personal information may be shared among our affiliated companies. We will only share necessary personal information for the purposes specified in this Privacy Policy. If we share your sensitive personal information or if affiliated companies change the purpose of using or processing your personal information, we will seek your authorization again.

4.1.2 To deliver comprehensive and high-quality products and services, we collaborate with trusted third-party service providers including cloud server hosting providers, data analytics service providers, and payment settlement service providers. We only share your personal information for legitimate, necessary, specific, and clearly defined purposes, and exclusively share the minimum information required to provide services. All partnerships strictly adhere to rigorous data protection protocols, and we never share your data with third parties. Partners are prohibited from using shared personal information for any other purposes. 4.2 Assignment

We will not transfer your personal information to any company, organization, or individual except under the following circumstances:

4.2.1 Transfer with explicit consent: Upon obtaining your explicit consent, we will transfer your personal information to third parties.

4.2.2 In cases involving mergers, acquisitions, or bankruptcy liquidation that require the transfer of personal information, we will notify you in advance and require the new entity holding your personal information to continue complying with this Privacy Policy. Otherwise, we will require the entity to obtain your authorization again.

4.3 Public Disclosure

We will only publicly disclose your personal information under the following circumstances:

1) Upon obtaining your explicit consent;

2) Disclosure based on legal or reasonable grounds: We may publicly disclose your personal information under circumstances such as legal requirements, legal procedures, litigation, or mandatory requirements imposed by government authorities.

5.2 We continuously enhance the security of software installed on your device through advanced technical measures to prevent personal information leaks. For instance, we perform local encryption on certain data on your device to ensure secure transmission. To guard against viruses, trojans, or other malicious programs, websites may access information about installed applications or active processes on your device.

5.3 We have established a dedicated personal information protection security department, management systems, processes, and organizational structure to ensure information security. For example, we strictly limit the scope of employees authorized to access information, require them to comply with confidentiality obligations, and conduct audits.

5.4 We have established a comprehensive data breach emergency response plan to swiftly identify, contain, and resolve security incidents. In compliance with applicable laws and regulations, we will notify affected users and regulatory authorities within 72 hours of detection. Our emergency response team comprises cybersecurity experts, legal professionals, and communications specialists who collaborate closely to minimize the impact of breaches while providing transparent updates to users and stakeholders.

5.5 We will take all reasonable and feasible measures to ensure that no irrelevant personal information is collected. We will retain your personal information only for the duration necessary to achieve the purposes stated in this policy, unless extended retention is required by law or permitted.

5.6 The internet is not an absolutely secure environment. We strongly recommend taking proactive measures to protect your personal information, including refraining from sharing account credentials or other sensitive data with others. If you discover any personal information breach, please contact VibeWalls customer service immediately so we can take appropriate actions as requested.

5.7 The internet environment is not 100% secure. We will make every effort to ensure the security of any information you send to us. In the event of a personal information security incident, we will promptly notify you in accordance with local legal requirements, including: a summary of the incident and its potential impact, measures already taken or planned, actionable recommendations for risk mitigation, and remedial actions. Notifications will be sent via email or other means. If individual data subjects cannot be contacted individually, we will issue public announcements through appropriate channels. Additionally, we will proactively report the handling of personal information security incidents as required by regulatory authorities.

6.Your Rights

We fully understand your concerns regarding personal information. To facilitate easier access, updates, supplementation, or deletion of your personal data, and to ensure your rights to withdraw consent for data usage and account cancellation, we have incorporated user-friendly settings into our product design. Please refer to the following instructions for operation. Additionally, we have established dedicated complaint reporting channels to ensure prompt handling of your feedback.

6.1 Access to your personal information

Access basic information such as birthday, gender, and profile picture: After logging in, click "My" and then tap the profile picture icon to view your information.

6.2 Access Google/Apple ID account information

After signing in, click "My", then click the settings button in the upper right corner, and select "Account Management" to access your information.

If you are unable to access your personal information through the aforementioned channels, please contact us via Section 10 "Contact Us" in this Privacy Policy. VibeWalls will respond to your request within 15 days.

If you encounter difficulties in exercising the aforementioned rights, or if we are currently unable to provide online self-correction/modification services, you may request corrections or modifications of erroneous or incomplete data upon completing identity verification while ensuring the objectivity and accuracy of information. In specific circumstances, particularly when data errors occur, you may submit correction requests through our published feedback and error reporting channels to request data updates—unless otherwise stipulated by laws and regulations. However, for security and identity verification considerations, certain initial registration information submitted during registration may not be modifiable.

6.3 Delete your personal information

You can also delete certain personal information yourself through the methods listed in this section "Access, Correct and Supplement Your Personal Information".

You may request us to delete your personal information under the following circumstances:

1) Our handling of personal information violates laws and regulations;

2) We collect or use your personal information without your explicit consent;

3) Our handling of personal information constitutes a serious breach of the agreement with you;

4) You cease using our products or services, or you voluntarily cancel your account;

5) We will permanently cease providing you with products or services.

If we decide to respond to your deletion request, we will also notify entities that have obtained your personal information from us to delete it promptly, unless otherwise required by laws and regulations or these entities have obtained your explicit authorization.

After you delete information from our services, we may not immediately remove the corresponding data from the backup system. We securely store your personal information and isolate it from any further processing until the backup can be cleared or anonymized.

6.7 Withdrawal of Your Consent to Personal Information

Some products and services we provide require access to your device. You can revoke this permission at any time after authorization. To revoke authorization: go to Phone System Settings> Permission Management. Revoking authorization does not affect personal information processing activities that have been performed based on your previous authorization.

6.8 Response to your above request

To ensure security, you may need to submit a written request or verify your identity in another way. We may first require you to verify your identity before processing your request.

We will respond within 15 days. Requests that are unwarranted, repetitive, require excessive technical measures, pose risks to the legitimate rights and interests of others, or are highly impractical may be rejected.

According to laws and regulations, we cannot respond to your request under the following circumstances:

1) Local laws do not grant relevant rights to data subjects;

2) Unable to verify the applicant's identity;

3) The application cannot be verified or exceeds the scope, particularly in cases of duplicate submissions;

4) The requested information pertains to compensation that we may make or receive due to ongoing disputes, and disclosing such information may harm our interests;

5) The retained information is used solely for statistical and research purposes, and the publication of statistical and research results will not disclose personal identity;

6) Other circumstances prescribed by law.

If we reject the data subject's request, we will provide the requester with a formal explanation.

7.How we store your personal information

7.1 International Data Transmission

Your information may be stored on servers located outside your country of residence, such as Singapore. In these locations, privacy laws may provide less protection than in your state, province, or country.

7.2 Information Storage Period

We will retain your personal information only for the duration necessary to fulfill the purposes specified in this policy, unless otherwise required by applicable laws and regulations. Generally, we will store your personal information upon collection and will delete or anonymize it within a reasonable period after you log out of your Vibewalls account. Personal information that has exceeded the retention period will be promptly deleted or anonymized.

In the event of a suspension of our products or services, we will notify you via push notifications or official announcements, and delete or anonymize your personal information within a reasonable timeframe.

8.How we handle personal information of minors

Our services are primarily intended for adults aged 18 and above. If you are between 13 and 18 years old, you must read these terms under the supervision of your parents or guardians and obtain their consent before using the services. We will not knowingly collect personal information from children under 13 years old. Should we accidentally collect children's personal data through our products, we will immediately delete such information in accordance with applicable laws and terminate the affected child's account.

As a parent or guardian, you may request the deletion of your child's account or download their personal data. According to the legal provisions of your state, you may also exercise relevant rights regarding your minor child's account through the aforementioned channels and submit other compliant requests. We will strictly process all your requests in accordance with applicable laws.

9.How to update this policy

9.1 To enhance your experience, we will periodically update the terms of the "VibeWalls Privacy Policy" in accordance with product updates and regulatory requirements. These updates form an integral part of the Privacy Policy. Without your explicit consent, we will not reduce your rights under this policy. If such updates materially weaken or significantly alter your rights, we will notify you through prominent notices or other means prior to policy implementation. By continuing to use our services, you acknowledge that you have read, understood, and agreed to be bound by the revised "VibeWalls Privacy Policy."

9.2 Significant changes include but are not limited to:

1) Significant changes have occurred in our service model, including the purposes for processing personal information, the types of personal information processed, and the methods of personal information utilization;

2) Significant changes in ownership structure or organizational framework, such as business restructuring, bankruptcy, mergers and acquisitions;

3) Changes in the primary recipients of personal information sharing, transfer, or public disclosure;

4) Significant changes occur in your rights regarding personal information processing and the manner of exercising such rights;

5) Responsible department for handling personal information security, contact details, and changes in complaint channels;

6) When the Personal Information Security Impact Assessment Report indicates high risk.

10.1 All notices under this Agreement may be delivered via page reminders, email or other means and shall be deemed served on the date of dispatch.

10.2 The conclusion, entry into force, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China.

10.3 This Agreement is executed in Hong Kong Special Administrative Region of the People's Republic of China.

10.4 In the event of any dispute or conflict between you and VibeWalls, you shall first attempt to resolve it through amicable negotiation. If negotiations fail, you hereby agree to submit the dispute to the competent People's Court at the place where this agreement is executed for litigation resolution.

10.5 The headings of all terms in this Agreement are for reference only, do not constitute the actual meaning of the Agreement, and shall not be used as the basis for interpreting the Agreement.

10.6 If any provision of this Agreement is partially invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding on both parties.
